The 2024 Child Care and Development Fund (CCDF) Final Rule updates regulations (45 CFR Part 98) to help working families afford child care and broadly support child care quality and accessibility in communities. Policies included in this final rule are designed to:

  • Lower child care costs for families;
  • Improve payments to child care providers;
  • Increase child care options for families;
  • Make enrollment easier and faster for families; and
  • Increase clarity in CCDF requirements.

On March 1, 2024, the Department of Health and Human Services, Administration for Children and Families published updates to the Child Care and Development Fund (CCDF) regulations (45 CFR Part 98) through a Final Rule published in the Federal Register. While Tribal CCDF Lead Agencies are exempt from most of the new requirements in this Final Rule, there are several important new flexibilities for Tribes related to construction, family co-payments, and provider payment practices.

Specifically, this final rule supports Native families by lowering child care costs and making enrollment easier and faster. The final rule also provides increased flexibility for Tribal Lead Agencies on construction renovations and spending deadlines as well as approaches to provider payments. Tribal Leaders, Tribal CCDF Lead Agencies, Tribal child care providers, Tribal families, and other interested parties are encouraged to read this Final Rule and related resources. Unless explicitly stated in the Subpart I of the Final Rule, regulations in previous final rules remain in effect for Tribal Lead Agencies.

Tribal leaders or their designated representatives were invited to join OCC in Albuquerque, New Mexico, on November 29 and 30, 2023 for an in-person consultation regarding the RFI titled: Meeting the Child Care Needs in Tribal Nations.  This report captures the information gathered during this consultation.

Tribal leaders in Alaska or their designated representatives were invited to join OCC in Anchorage, Alaska, on November 27, 2023, for an in-person consultation regarding a RFI titled: Meeting the Child Care Needs in Tribal Nations. This report captures the information gathered during this consultation.

This Program Instruction is a reminder of the ACF-696T Financial Reporting Form for the Tribal Lead Agencies. The Office of Management and Budget (OMB) approved the Form ACF-696T under OMB 0970-0510.

The purpose of this program instruction is to remind Tribal Lead Agencies of the annual reporting requirements (i.e., ACF-700 Report), consistent with the terms and conditions of the CCDF program.  The ACF-700 form is attached. 

Tribal Leaders or their designated representatives were invited to join the Office of Child Care (OCC) for a virtual consultation regarding a notice of proposed rulemaking (NPRM) titled: Improving Child Care Access, Affordability, and Stability in the Child Care and Development Fund (CCDF).

On July 27, 2023, the Department of Health and Human Services, Administration for Children and Families (ACF) published a formal request for information (RFI) on the child care requirements, regulations, and processes for Tribal Nations that administer the Child Care and Development Fund (CCDF) program.

The purpose of this program instruction is to

  1. To provide information to state, territory, and tribal lead agencies regarding the distribution of child care disaster recovery funds, and
  2. To provide guidance on allowable activities, how to apply, obligating and expending funds, reporting requirements, recipient monitoring, and other requirements.
